ย The Departmental Committee on Environment, Forestry and Mining participated in a comprehensive legal and policy briefing on three significant Bills: The Mining Amendment Bill, 2023, the Gold Processing Bill, 2023 and the Environmental Management and Coordination (Amendment) Bill, 2023.

In a session chaired by Vice Chairperson, Hon. Charles Kamuren (Baringo South), the inputs provided crucial insights into the proposed legislative changes.ย 

Sponsored by Hon. David Gikaria (Nakuru Town East), the Mining Amendment Bill, 2023 seeks to amend the Mining Act No. 12 of 2016 to provide for separate implementation of the three key functions in the Act: policy formulation, administrative and dispute resolution functions.

ย On the other hand, the Members were told that the Gold Processing Bill, 2023 provides for the establishment, composition, functions and management of the Gold Processing Corporation; application, cancellation and renewal of processing licences. The Bill is sponsored by Hon. Benard Shinali (Ikolomani).

ย The Environmental Management and Coordination (Amendment) Bill, 2023 sponsored by Hon. Irene Nyakerario (nominated), targets section 147 (2) of the Environment Management and Coordination Act, No. 8 of 1999.

The proposed amendment introduces a new subsection 2(ba), empowering regulations by the Cabinet Secretary to prohibit the introduction, growth or maintenance of eucalyptus trees along any river, lake, sea or wetland. This is meant to mitigate the environmental impact of water-intensive eucalyptus trees in critical water catchment areas, thereby safeguarding ground water resources and preventing water level depletion.

Through these Bills, the policy makers aim to promote sustainable development, resource management and environmental preservation for the benefit of present and future generations.
