The Select Committee on Parliamentary Broadcasting and Library chaired by Hon. Daniel Nanok (Turkana West) Β with representatives from the State Department for Parliamentary Affairs to receive submissions on the Public Participation Bill, 2023.
Β The Public Participation Bill seeks to provide a framework for effective public participation. The Constitution of Kenya 2010 ushered in a new system of governance that places the people at the centre.
Β According to submissions by the State Department on Parliamentary Affairs, public participation has, for example, been an issue of contention in approximately 2,182 judicial decisions. This is according to the number of reported judicial decisions available on the National Council for Law Reporting platform.
The Parliamentary Affairs Department further acknowledged the differences in public participation processes across various entities. Adding that some of the existing laws have not defined what public participation is, while others have attempted to do so have different interpretations and scopes on what public participation is.
During the meeting Members acknowledged the legal grey areas concerning public participation.
The Committee committed to reviewing the State Department's memoranda alongside others submitted by various stakeholders.
