The National Assembly is expected to continue prosecuting its case against Deputy President Rigathi Gachagua this morning, on the second day of the hearing on his impeachment trial.

Speaker Amason Kingi adjourned the hearing on the first day, Wednesday 16 October, after the National Assembly called two of its four witnesses.

The first witness to take the stand was Hon Mwengi Mutuse, the Kibwezi West MP, who was the mover of the Motion followed by Dr Andrew Mulwa who briefly served as the acting CEO of the Kenya Medical Supplies Agency (KEMSA).

Hon Mutuse took the stand to defend his Motion on the Removal of the Deputy President from office, telling Senators that the country’s second in command had since his election, been promoting policies that sought to exclude some regions from their share of the national cake.

He particularly singled out remarks that have been attributed to the Deputy President in which he described Kenya as a company whose controlling interests are in line with respective shareholding.Β

β€œThe DP has visited various parts of the country and promoted the notion that Kenya is a company that is owned by shareholders and that those who own shares in the company would benefit in development in terms of service delivery,” said Hon Mutuse, who insisted that Kenya is not a company.

Β 

The MP was however taken to task by Deputy President Gachagua’s legal team led by advocate Elisha Ongoya who focused his cross-examination on varied allegations, including that the DP threatened a judge of the High Court, Justice Esther Maina; that he used his companies to enrich himself through corruption; and utterances linked to the DP over demolitions of structures in Kayole, Nairobi County.

Dr Mulwa focused his evidence on the multimillion procurement of mosquito nets at the agency which was allegedly awarded to a company linked to the DP and members of his family.

Β 

Speaker Kingi adjourned the hearing at 11.12 PM on Wednesday, and ordered the Senators to seek clarification from the two witnesses on Thursday.

The House is expected to shoot questions to the two witnesses before the final two are called to the witness box.

Β 

The National Assembly will then rest its case and allow the defence to present its case.Β 

Β 

The Deputy President is expected to take the stand in his own defence as the sole witness.
