Members of the National Assembly had the opportunity to give comments on the findings of the Report of the Select Committee on its investigation into the proposed dismissal of Hon. Franklin Mithika Linturi as Cabinet Secretary for Agriculture and Livestock Development.

Β While tabling the Report, Committee Chairperson, Hon. Naomi Waqo (Marsabit) citedΒ  Article 152(7) if the Constitution saying the Select Committee conducted the hearings to investigate the matters alleged in the Special Motion seeking the dismissal of the Hon. Franklin Mithika Linturi, Cabinet Secretary for Agriculture and Livestock Development on three grounds: Allegations of gross violation of the Constitution or any other law; serious reasons to believe that the Cabinet Secretary has committed a crime under national law; and gross misconduct of the Cabinet Secretary.

Β Hon. Waqo added that the Committee having found that the allegations against the Cabinet Secretary are unsubstantiated, there should be no further proceedings on the matter.

Β The 11-Member Committee had 10 days to determine whether the allegations against the Cabinet Secretary have been substantiated.

Β The Select Committee's findings were met with mixed reactions with some MPs supporting the Committee findings and others opposing.

Β Leader of the Minority Party, Hon. Opiyo Wandayi (Ugunja) argued that there is the need for further investigation due to the Motion's unprecedented nature.

Β The Select Committee held a total of 12 sittings with the Hon. Jack Wamboka and CS Linturi appeared before it on May 8, 9 and 10, 2024.Β 

Β Thereafter, the Committee considered the submissions from both parties in accordance with the Constitution, the relevant laws, the National Assembly Standing Orders and its Rules on the Conduct of the Investigation.Β 

Β Speaker of the National Assembly, Hon. Moses Wetang'ula emphasized the Select Committee's adherence to the Constitution saying it had performed its role and stands dissolved.

Β Β "The Select Committee has discharged its Constitutional mandate. Being an ad-hoc committee, the Select Committee now stands dissolved,” Speaker Wetang’ula said.
