The Committee on National Cohesion and Equal Opportunity, last week tabled a report regarding the Employment of Persons With Disabilities (PWDs) in Public Institutions.

The Chairperson of the Committee, Hon Yussuf Haji (Mandera West) told the House that an inquiry conducted by the Committee recently, in selected 39 public institutions, revealed that only one institution met the mandated threshold for appointment of PWD.

Β Article 54 (2) of the Constitution of Kenya, 2010 states that PWD should make up at least five percent of the workforce.

"In our audit, the Committee observed that most of the institutions had not complied with the required threshold for appointment of PWD. The average percentage of PWD representation in each of the sampled institutions stood at 2.1 percent," Hon. Haji said.

Hon. Duncan Mathenge (Nyeri Town) said there has to be consequences for the violation of the Constitution and the law.

Β "Heads of public institutions and agencies must be held to account if they fail to ensure PWD are excluded from their workforce." He said.

Hon. Timothy Toroitich (Marakwet West) noted that it was shameful that public institutions have failed to comply with the law.

"It's shameful that public institutions have failed to comply with the law. As a House, we should take comprehensive steps to ensure that the agencies have proper representations of PWD,” said Hon. Toroitich.

Hon Millie Odhiambo (Suba North) stressed the importance of upholding Constitutional rights.

"Our constitution is very clear when it comes to the employment rights of PWD.Β  We should not allow the entrenched culture of impunity to stop persons with disabilities from getting employment,” said.

Making her contribution, Hon Rose Mumo (Makueni) said PWD are abled differently and should be given a chance to work.

Β "PLWDs are abled differently and should be given a chance to work, just like any other Kenyan. We should make it unlawful for any institution, both in the public and private sector, to operate without meeting the minimum threshold of PLWD representation," stated Hon Mumo.

Hon. Jackson Kosgei (Nominated) reiterated the need for prioritizing the rights of PWD saying the rights of PWD are human rights and should be respected.
