Background and Mandate

On Wednesday, 16^th August 2023 and Tuesday, 29^th August 2023, the National Assembly and the Senate, respectively, established the National Dialogue Committee. The mandate of the Committee is to facilitate dialogue and consensus building and recommend appropriate constitutional, legal and policy reforms on issues of concern to the people of Kenya, as framed by the National Dialogue Committee, in line with the Constitution and the laws of the Republic of Kenya and respecting the functional and institutional integrity of state organs.

The National Dialogue Committee has framed the following five (5) issues of concern to the people of Kenya:

ISSUE 1-Outstanding Constitutional Matters:

1. Article 43 of the Constitution, the Cost of Living and related issues;
2. implementation of the “two-thirds gender rule”;
3. governance issues, including promoting national unity and inclusivity  in public appointments; and
4. adequate checks and balances.

ISSUE 2- Electoral Justice and Related Matters:

1. restructuring and reconstitution of the Independent Electoral and  Boundaries Commission (“the IEBC”);
2. boundaries delimitation; and
3. audit of the 2022 presidential election.

ISSUE 3-Entrenching Funds into the Constitution:

1. the National Government Constituencies Development Fund;
2. the National Government Affirmative Action Fund; and
3. the Senate Oversight Fund.

ISSUE 4- Establishment and Entrenchment of State Offices:

1. the office of the Leader of the Official Opposition; and
2. the office of the Prime Cabinet Secretary.

ISSUE 5- Fidelity to Political Parties/Coalitions and the law on multiparty democracy: Preventing interference with political parties/coalitions.

In line with Article 10 of the Constitution of Kenya and its mandate, the National Dialogue Committee placed adverts in the local dailies on Friday, 1^st September 2023 seeking views from the public in the form of Memoranda on the aforementioned issues.
