NOTIFICATION OF THE FIRST SITTING OF THE NATIONAL ASSEMBLY AND ELECTION OF THE SPEAKER OF THE NATIONAL ASSEMBLY

NOTIFICATION OF THE FIRST SITTING OF THE NATIONAL ASSEMBLY AND ELECTION OF THE SPEAKER OF THE NATIONAL ASSEMBLY

WHEREAS, Article 106 of the Constitution provides that there shall be a Speaker of
each House of Parliament, who shall be elected by that House in accordance with the
Standing Orders, from among persons who are qualified to be elected as Members
of Parliament but are not such members and that the Office of the Speaker shall
become vacant when a new House of Parliament first meets after an election.


AND WHEREAS, in furtherance to the provisions of Article 126(2) of the Constitution,
His Excellency the President of the Republic of Kenya and Commander in Chief
of the Kenya Defence Forces has, vide Gazette Notice No.10527 of 5th September
2022, notified that the first sitting of the National Assembly shall be held at the
National Assembly Chambers, Main Parliament Buildings, Nairobi, on Thursday,
September 8, 2022 at 9.00 am.


FURTHER WHEREAS, Article 106 of the Constitution and Standing Order 5 of
the National Assembly Standing Orders provide that the Office of the Speaker of
the National Assembly shall become vacant upon the first sitting of the National
Assembly.


NOW THEREFORE, pursuant to Article 106 of the Constitution and Standing Order
5 of the National Assembly Standing Orders, it is notified -


(a) for the information of the general public that pursuant to Article 106 of the
Constitution and Standing Order 5 of the National Assembly Standing Orders,
the office of the Speaker of the National Assembly shall become vacant on
Thursday, September 8, 2022 ;
(b) that interested persons who qualify to be elected as Speaker under Articles
106(1)(a) and 99 of the Constitution are hereby INVITED to submit their
nominations papers for election;
(c) that, in view of the time constraints occasioned by the date of receiving the
notification under Article 106 of the Constitution, nomination papers can be
COLLECTED (in person) by interested persons from the Office of the Clerk
of the National Assembly, First Floor, Main Parliament Buildings, Nairobi
on the following dates and times-
(i) on Monday, September 5, 2022 between 2.30 pm and 8.30 pm;
(ii) on Tuesday, September 6, 2022 between 7.00 am and 8.30 pm; and,
(iii) on Wednesday, September 7, 2022 between 8.00 am and 12.30 pm;
(d) that, the NOMINATION DAY for the purpose of RECEIVING the nomination
papers shall be on Wednesday, September 7, 2022 from 2.30 pm to 8.30
pm in Committee Room No. 7, First Floor, Main Parliament Buildings,
Nairobi. At the nominated time on the nomination day, interested persons
should return the completed nomination papers together with-
(i) a letter from the Independent Electoral and Boundaries Commission
evidencing the fact that the candidate is qualified to be elected as a
Member of Parliament under Article 99 of the Constitution and the
candidate is not such a Member;
(ii) the curriculum vitae of the candidate; and
(iii) certificates and other relevant supporting documents, in accordance
with Article 99(2) of the Constitution; and
(e) that, at the First Sitting of the House, the Members-Elect shall be sworn-in,
in accordance with the requirements of Article 74 of the Constitution and
immediately thereafter the House shall proceed to elect a Speaker and Deputy
Speaker of the National Assembly in accordance with Article 106 of the
Constitution.
