The National Assembly has passed the East African Development Bank (Amendment) Bill (National Assembly Bill No. 33 of 2026), which seeks to strengthen parliamentary oversight over the release of public funds to the regional development lender.
The Bill proposes amendments to the East African Development Bank Act to require National Assembly approval before public funds are charged to or released from the Consolidated Fund for payment to the East African Development Bank (EADB).
Sponsored by the Leader of the Majority Party, Hon. Kimani Ichungβwah, the proposed legislation seeks to enhance accountability and ensure that payments to the Bank are subjected to parliamentary scrutiny. The Bill was published in the Kenya Gazette Supplement No. 137 of 2026 on 5 June 2026.
Under the proposed amendments, payments to the Bank would be provided for through an Appropriation Act and subject to approval by the Controller of Budget. The Bill also proposes that the Cabinet Secretary responsible for the National Treasury submit a report to the National Assembly detailing payments made to the Bank within three months after the end of each financial year.
The proposed changes would further require National Assembly approval for arrangements to raise loans through securities to finance payments to the Bank, introducing an additional layer of legislative oversight over the financial commitments.
The Bill also proposes amendments to provisions in the Schedule to the principal Act concerning the Bankβs privileges and immunities, including its creditor status and protections relating to its property and assets.
