The National Assembly passed the Kenya Roads (Amendment) (No.2) Bill, 2025 on Tuesday, 29 July 2025. The Bill introduces reforms in the management of Kenya’s road agencies, including the reduction of the term of office for Directors-General from five to three years.

The Bill, sponsored by the Leader of the Majority Party, Hon. Kimani Ichung’wahΒ aligns the Kenya Roads Act and the Kenya Roads Board Act with the Mwongozo Code of Governance for State Corporations, enhancing uniformity and accountability across the road infrastructure sector.

A key amendment introduced during the Committee stage under New Clause 3A amends Section 12(4) of the Kenya Roads Board Act (Cap. 408A) by replacing the term β€œfive years” with β€œthree years” in reference to the tenure of the Director-General.

β€œThe purpose of this amendment is to ensure consistency in the management of road agencies and compliance with the Mwongozo Code,” said Hon. Ichung’wah while moving the motion for the Second Reading of the new clause.

Supporting the amendment, Hon. TJ Kajwang’ (Ruaraka) emphasised the need for harmony across legal frameworks:

β€œThis proposal ensures uniform application of the law. I encourage the Leader of the Majority Party to also introduce amendments to Section 6 of the State Corporations Act to avoid conflicts in the appointment terms of board members and directors,” he stated.

The Kenya Roads (Amendment) (No.2) Bill, 2025, now awaits transmission to the Senate for concurrence.
